Article 46 of Regional Law No. 6 of April 4, 2012 provides new penalty values for users of public transportation services, which are reduced to amounts ranging from a minimum of 10 to a maximum of 50 times the ticket price.

These are the details of the penalty amounts as of 01/01/2025:

Penalties and Appeals

An administrative penalty of €5.00 applies in cases where a valid travel pass and identification card are not presented during an inspection due to forgetfulness. Holders of a valid season ticket and identification card who fail to present them during the inspection may have the penalty notice cancelled by visiting the company ticket office in Como, located in Piazza Matteotti, or the ticket office in Menaggio, within 5 days from the date of the penalty notice, during the opening hours of the URP (Public Relations Office). They must bring the original monthly or annual season ticket that was valid at the time of the offence.

The offender or any other person held responsible may ask the inspector to record any comments or objections in the penalty notice. Within 30 days from the date on which the violation is reported or notified, they may also submit written representations and supporting documents to the company management at its headquarters in Como, Via Asiago 16/18, and may request to be heard by the management. Please note that the deadlines for payment indicated in the penalty notice will not be suspended or extended under any circumstances.

If payment is made immediately, the penalty notice serves as a receipt, and no appeal may be lodged thereafter.

The offender or any other person held responsible may also appeal to the Giudice di Pace, in accordance with the procedures and time limits established by applicable law.

If misuse of identification cards or free-travel passes is established, the company may permanently confiscate the document, in addition to requiring payment of the fine and the applicable ticket fare.

Minors

As minors are not permitted to pay the penalty notice on board, their parent or legal guardian has two options to benefit from the reduced penalty amount of €25:

• Bank transfer: payment must be made by 00:00 (midnight) on the same day.
• In person: payment must be made on the same day at the ticket office in Piazza Matteotti, Como.
